OCDE publică un nou document – „Ghidul de implementare a impozitului minim global”
Pe 30 aprilie 2026, OCDE publică acest nou ghid, destinat autorităților fiscale din jurisdicțiile care au transpus în legislația internă Regulile-model globale de combatere a erodării bazei impozabile (pilonul doi) („Regulile-model”). Astfel, în acest ghid sunt adresate principalele provocări operaționale în implementarea Regulilor-model și sunt prezentate mecanismele deja implementate în unele state în privința impozitului suplimentar și a impozitului suplimentar național.
Acest nou ghid oferă indicații pas-cu-pas privind implementarea Pilonului doi al OCDE, fiind structurat în două etape – etapa pre-implementare și etapa implementare a Regulilor-model:
1. Etapa pre-implementare
Această etapă privește, în esență, evaluarea impactului adoptării acestor reguli-model (de ex. prin evaluarea numărului de subiecți ai impozitului suplimentar / impozitului suplimentar național utilizând raportările Public Country-by-Country sau „CbCR”).
2. Etapa de implementare
În această etapă, Ghidul oferă, în principal, îndrumare privind implementarea mecanismelor de colectare și conformare privind impozitului suplimentar / impozitului suplimentar național, precum și privind schimbul de informații între autoritățile fiscale.
Menționăm, totuși, că acest Ghid are caracter facultativ, însă este un instrument util în a înțelege mecanismele care stau la baza obligațiilor de conformare în legătură cu Pilonul doi al OCDE.
OECD Publishes New Toolkit on the Implementation of the Global Minimum Tax
On 30 April 2026, the OECD published new guidance intended for tax authorities in jurisdictions that have incorporated the Global Anti-Base Erosion (GloBE) Model Rules (Pillar Two) (the “Model Rules”) into their domestic legislation. The guidance addresses the main operational challenges associated with the implementation of the Model Rules and presents mechanisms already adopted in certain jurisdictions with respect to the domestic top-up tax.
This new guidance provides step-by-step instructions on the implementation of the OECD Pillar Two framework and is structured around two phases: the pre-implementation phase and the implementation phase of the Model Rules.
1. Pre-implementation phase
This phase primarily concerns the assessment of the impact of adopting the Model Rules. For example, jurisdictions may evaluate the number of entities that could be subject to the top-up tax or domestic top-up tax by using information derived from public Country-by-Country Reporting (Public CbCR).
2. Implementation phase
During this phase, the guidance mainly provides direction on the implementation of collection and compliance mechanisms relating to the top-up tax and domestic top-up tax, as well as on the exchange of information between tax authorities.
It should be noted, however, that this guidance is not legally binding and remains optional in nature. Nevertheless, it represents a useful tool for understanding the mechanisms underlying the compliance obligations associated with the OECD Pillar Two framework.
