Începând de săptămâna aceasta, cum se obține acordul vecinilor pentru autorizația de construire
Atunci când trebuie luate măsuri pentru punerea în siguranță a unor clădiri învecinate, cei ce vor să obțină o autorizație de construire trebuie să primească, în prealabil, și acordul vecinilor, după cum stabilește Codul amenajării teritoriului, urbanismului și construcțiilor, care se va aplica de marțea viitoare.
Printre altele, Codul amenajării teritoriului, urbanismului și construcțiilor, cuprins în Legea 169/2026, care se va aplica din 25 august, extinde și clarifică mecanismul existent privind obținerea acordului vecinilor în cazul realizării unor lucrări de construcții.
Concret, noile prevederi din cod stabilesc faptul că “solicitantul autorizației de construire are obligația să obțină acordul vecinilor sau al asociației de proprietari, după caz, exprimat în formă autentică, în situația în care pentru realizarea lucrărilor de construire sau amenajare sau chiar desființare propuse sunt necesare măsuri de intervenție pentru punerea în siguranță a construcțiilor existente identificate prin concluziile expertizei tehnice sau ale raportului de expertiză tehnică preliminară privind influența asupra vecinătăților, după caz”.
Dacă vecinul este un imobil aparținând instituțiilor din Sistemul Național de Apărare, Ordine Publică și/sau Siguranță Națională, solicitantul autorizației de construire va avea obligația de a obține atât avizul instituției respective, cât și acordul vecinului în sine.
Dacă nu sunt de acord cu lucrările propuse, vecinii pot refuza emiterea acordului solicitat, dar trebuie ca refuzul să fie justificat. Ce înseamnă un refuz justificat – executarea lucrărilor de construire este contrară legii sau executarea acestora afectează imobilul vecinului, fără a fi cuprinde sau furniza soluții adecvate de remediere a situației cauzate construcției vecine.
Refuzul nejustificat de a-și da acordul va fi constatat de către instanța de contencios administrativ competentă, hotărârea acesteia urmând să fie acceptată de către emitentul autorizației de construire ori de desființare în locul acordului vecinilor.
De asemenea, pe tot parcursul perioadei de autorizare, vecinii vor avea obligația de a permite accesul experților tehnici pentru analizarea stării reale a clădirilor vecine și a modului în care impactul asupra acestora există și produce efecte.
Acest mecanism de obținere a acordului vecinilor nu se aplică lucrărilor inginerești de interes public național sau local.
Starting this week, how to obtain the neighbors’ agreement for the building permit
When measures must be taken to secure neighboring buildings, those who want to obtain a building permit must also receive the consent of their neighbors in advance, as established by the Territorial Planning, Urban Planning and Construction Code, which will apply from next Tuesday.
Among other things, the Territorial Planning, Urban Planning and Construction Code, contained in Law 169/2026, which will apply from August 25, extends and clarifies the existing mechanism for obtaining the consent of neighbors in case of construction works.
Specifically, the new provisions of the code establish that “the applicant for the building permit has the obligation to obtain the consent of the neighbors or the owners’ association, as the case may be, expressed in authentic form, in the situation in which in order to carry out the proposed construction or arrangement works or even dismantling, intervention measures are necessary to make the existing constructions identified by the conclusions of the technical expertise or of the preliminary technical expertise report on the influence on the vicinity, as the case may be”.
If the neighbor is a building belonging to the institutions of the National System of Defense, Public Order and/or National Security, the applicant for the building permit will have the obligation to obtain both the approval of the respective institution and the agreement of the neighbor himself.
If they do not agree with the proposed works, the neighbors can refuse to issue the requested agreement, but the refusal must be justified. What does a justified refusal mean – the execution of the construction works is contrary to the law or their execution affects the neighbor’s building, without containing or providing adequate solutions to remedy the situation caused to the neighboring construction.
The unjustified refusal to give its consent will be ascertained by the competent administrative court, its decision being accepted by the issuer of the building or demolition permit instead of the neighbors’ agreement.
Also, throughout the authorization period, neighbors will have the obligation to allow access to technical experts to analyze the real condition of neighboring buildings and how the impact on them exists and produces effects.
This mechanism for obtaining the consent of the neighbors does not apply to engineering works of national or local public interest.
