Tax Alert – Lege măsuri fiscal – bugetare

 

În 25 iulie 2025 s-a publicat în Monitorul Oficial Legea nr. 141/2025 privind unele măsuri fiscal-bugetare, ce introduce un set de măsuri fiscal-bugetare, spre a reduce deficitul bugetar al României. Acesta este un prim pachet legislativ dintr-o serie de măsuri ce vor fi introduse în perioada următoare.

Dintre măsurile introduse de Legea nr. 141/2025, le amintim pe următoarele:

• Impozitarea societăților și a dividendelor:

◦ Impozit pe dividende: Cota de impozitare crește de la 10% la 16%, începând cu 1 ianuarie 2026.
Regulă tranzitorie: Pentru dividendele distribuite în baza situațiilor financiare interimare din 2025, se aplică cota de 10%.
◦ Impozit suplimentar pentru bănci: Cota impozitului pe cifra de afaceri crește progresiv, ajungând la 4% pentru perioada 1 iulie 2025 – 31 decembrie 2026.

• Taxa pe Valoarea Adăugată (TVA) – de la 1 august 2025:

◦ Cota Standard: Crește de la 19% la 21%.
◦ Cota Redusă: Cotele de 5% și 9% se unifică într-o singură cotă de 11%. Aceasta se va aplica pentru alimente de bază, medicamente, cărți, servicii HoReCa și energie termică.
◦ Produse care trec la cota standard de 21%:

▪ Biscuiții și cozonacul cu un conținut de zahăr adăugat de minimum 10g/100g produs.
▪ Livrările de locuințe cu o suprafață de până la 120 mp și o valoare de maximum 600.000 lei.
Regulă tranzitorie: Se menține cota de 9% pentru locuințele care fac obiectul unor antecontracte încheiate înainte de 1 august 2025, dacă livrarea are loc până la 1 august 2026.

• Impozitarea persoanelor fizice și contribuții sociale – de la 1 august 2025:

◦ CASS pentru pensii: Se introduce CASS în cotă de 10% pentru partea din venitul lunar din pensii care depășește pragul de 3.000 de lei. Măsura este temporară, până la 1 ianuarie 2028.
◦ CASS pentru alte venituri: Se introduce plata CASS pentru indemnizația de șomaj și indemnizația pentru creșterea copilului.
◦ Statutul co-asiguraților: Soțul, soția și părinții fără venituri proprii, aflați în întreținerea unei persoane asigurate, nu mai beneficiază de asigurare gratuită. Aceștia trebuie să opteze și să plătească CASS pentru a fi asigurați.
◦ Indemnizații de Concediu Medical: Pentru boli obișnuite, cuantumul se reduce astfel:

▪ 55% pentru primele 7 zile de concediu.
▪ 65% pentru zilele 8-14.
▪ 75% pentru o durată de peste 15 zile.

• Accize și alte taxe Indirecte:

◦ Accize: Nivelul accizelor crește de la 1 august 2025 pentru produse energetice (benzină, motorină), alcool, tutun și produse cu zahăr.
◦ Rovinietă: De la 1 septembrie 2025, tariful anual va crește.

Tax Alert – Fiscal-Budgetary Measures

 

On the 25th of July 2025, Law no. 141/2025 on certain fiscal and budgetary measures was published in the Official Gazette, introducing a set of fiscal-budgetary measures aimed at reducing Romania’s budget deficit. This represents the first legislative package in a series of measures to be introduced in the upcoming period.

Among the measures introduced by Law no. 141/2025 the following are noteworthy:

• Taxation of companies and dividends:

◦ Dividend tax: The tax rate increases from 10% to 16%, starting from the 1st of January 2026.
Transitional rule: For dividends distributed based on interim financial statements from 2025, the 10% rate applies.
◦ Supplementary tax for banks: The turnover tax rate increases progressively, reaching 4% for the period between the 1st of July 2025 and the 31st of December 2026.

• Value Added Tax (VAT) – from the 1st of August 2025

◦ Standard rate: Increases from 19% to 21%.
◦ Reduced rate: The 5% and 9% rates are merged into a single reduced rate of 11%. This will apply to basic foodstuffs, medicines, books, HoReCa services, and thermal energy.
◦ Products moving to the 21% standard rate:

▪ Biscuits and “cozonac” (sweet bread) with an added sugar content of at least 10g/100g of product.
▪ The supply of dwellings with a surface area of up to 120 sqm and a value of a maximum of 600,000 lei.
Transitional rule: The 9% rate is maintained for dwellings subject to pre-contracts concluded before the 1st of August 2025, if the delivery takes place by the 1st of August 2026.

• Taxation of individuals and social contributions – from the 1st of August 2025

◦ CASS for pensions: A 10% Health Insurance Contribution (CASS) is introduced for the portion of the monthly pension income exceeding the 3,000 lei threshold. The measure is temporary, until the 1st of January 2028.
◦ CASS for other incomes: CASS payment is introduced for unemployment benefits and child-raising allowances.
◦ Status of co-insured persons: The spouse and parents without their own income, who are dependents of an insured person, no longer benefit from free insurance. They must opt-in and pay CASS to be insured.
◦ Sick leave allowances: For common illnesses, the amount is reduced as follows:

▪ 55% for the first 7 days of leave;
▪ 65% for days 8-14 of leave;
▪ 75% for a duration of over 15 days of leave.

• Excise duties and other indirect taxes

◦ Excise duties: The level of excise duties will increase from the 1st of August 2025, for energy products (gasoline, diesel), alcohol, tobacco, and products with sugar.
◦ Rovinieta (Vignette): From the 1st of September 2025, the annual fee for passenger cars shall increase.
