Dreptul persoanei impozabile de a reporta soldul sumei negative a TVA în decontul de TVA aferent perioadelor fiscale ulterioare nu este prescriptibil
Printr-o decizie pronunțată în data de 20 aprilie 2026, ICCJ a stabilit că art. 303 alin. (7) din Codul fiscal trebuie interpretat în sensul în care Dreptul persoanei impozabile de a reporta soldul sumei negative a TVA în decontul de TVA aferent perioadelor fiscale ulterioare nu este prescriptibil. Astfel, orice persoană impozabilă care are de reportat sume de TVA pe care le-a plătit și pe care nu le poate compensa cu TVA datorat, poate să facă acest lucru ulterior, până la încetarea activității, fără a i se putea opune prescripția.
Conform ICCJ, decizia aplică principiile constituționale ale fiscalității și ține seama de natura continuă, ciclică lunară a raportului balanței de TVA și asigură astfel egalitatea de tratament între contribuabil și organul fiscal, dând o expresie concretă drepturilor contribuabilului.
Decizia ICCJ vine în urma unui recurs în interesul legii formulat de Colegiul de conducere al Curții de Apel Brașov.
Decizia Instanței confirma abordarea pe care Biriș Goran a avut-o constant în ceea ce privește reportarea soldului sumei negative de TVA, de cele mai multe ori în contradicție cu abordarea organelor fiscale, abordare conform căreia, la împlinirea termenului de prescripție de 5 ani, se șterg efectiv din evidențele fiscale (fișa de plătitor) sumele negative de TVA ce provin din facturi mai vechi de 5 ani.
Această abordare în practica ANAF poate părea corectă la o prima vedere (raportat exclusiv la teoria generala a termenului de prescripție fiscală) însă ignoră cu desărvârșire faptul că depunerea lunară/trimestriala a decontului de TVA practic înnoiește soldul sumei negative de TVA, termenul de prescripție reînnoindu-se corespunzător.
Un exemplu extrem de relevant al efectelor practicii greșite a autorităților fiscale este în domeniul construcțiilor pentru care trebuie efectuate ajustări anuale, în cazul în care acestea sunt închiriate (total sau parțial) în regim de scutire. Ajustarea se face pe o perioadă de 20 de ani, iar ștergerea din fișă a TVA dedus la achiziție/construcție generează o situație de dublă impozitare.
Va fi interesant de urmărit care sunt considerentele ICCJ.

The taxpayer’s right to carry forward the balance of the negative VAT amount in the VAT return for subsequent tax periods is not subject to limitation
By a decision delivered on the 20th of April 2026, ICCJ established that art. 303 par. (7) of the Fiscal Code must be interpreted in the sense that the right of the taxpayer to carry forward the balance of the negative VAT amount in the VAT return for subsequent fiscal periods is not subject to prescription. Thus, any taxpayer who has to carry forward VAT amounts that it has paid and which it cannot offset against the VAT due, may do so subsequently, until the cessation of the activity, without the prescription being able to oppose it.
According to the ICCJ, the decision applies the constitutional principles of taxation and takes into account the continuous, monthly cyclical nature of the VAT balance report and thus ensures equal treatment between the taxpayer and the tax authority, giving concrete expression to the taxpayer’s rights.
The ICCJ decision comes following an appeal in the interest of the law filed by the Board of Directors of the Brașov Court of Appeal.
The Court’s decision confirms the approach that Biriș Goran has consistently taken regarding the carryover of the balance of the negative VAT amount, most often in contradiction with the approach of the tax authorities, an approach according to which, upon the expiration of the 5-year limitation period, negative VAT amounts originating from invoices older than 5 years are effectively deleted from the tax records (payer sheet).
This approach in ANAF practice may seem correct at first sight (related exclusively to the general theory of the fiscal limitation period), but it completely ignores the fact that the monthly/quarterly submission of the VAT return practically renews the balance of the negative VAT amount, the limitation period being renewed accordingly.
An extremely relevant example of the effects of the wrong practice of the tax authorities is in the field of constructions for which annual adjustments must be made, if they are rented (totally or partially) under an exemption regime. The adjustment is made over a period of 20 years, and the deletion from the record of the VAT deducted upon acquisition/construction generates a situation of double taxation.
It will be interesting to follow what are the ICCJ’s considerations.
